New Zealand legal advice for 17 year old cousin please?

The police found about 100 ecstasy tablets in my cousin's car today, and I have a few questions about likely outcomes. And no, I don't condone what he's done, I just care for him that's all.





Will he be charged with just possession or is there a chance he could be charged with trafficking? Will he be able to get bail?





He is 17 years old so will he appear in a juvenile or adult court? What are the likely outcomes for both courts? Will he have to go to jail?





He is the father of a 2 year old girl, will this be taken into account at court? He has also had a less than perfect family life, his mother walked out on the family when he was young and his father has virtually disowned him.





I know he has been in trouble with the police before as a minor, I'm not sure whether he was convicted, but I think he had to do some intervention program or something. Given that he has some previous criminal form, will this also go against him during his trial?

He will be charged with just possession unless he tried to transit the drugs through to another city illegally or try and smuggle them overseas. Since he is 17 he will appear in adult court as the law for persons 17 and over are charged as adults, it is uncertain to determine what would be the outcomes for the High Court, he could go to court if he committed serious offences like this one lots of times like more than 3 times in a consecutive row. It sounds like in your comment that he has been in trouble with the police, but the question is whether he has been let off with a warning or have faced Police Diversion? If he has than he may not go to jail, but if the police have already placed in court he may well have to face the consequences. Since he has already have a criminal form this will certainly be considered in the deliberation process. I hope I have been of good help to you. And Good luck to your cousin also.
