Divorce papers for that county in that state are available at the county court house, on line and in many office supply places. If the divorce is not contested, and the other side will sign without a big todo, agree how the estate, what there may be of it, is to be split. In places on the forms where there is nothing to declare, put the null set sign (a 0 with a slash thru it). Submit, with both signature to the countycourt house, along with the fee. The judge will sign it, stamp it, and copies sent to each of you with a date stating when you are each considered a single person. You can file for a legal separation.


In some states, you have to reside in either the state or county for 6 months before you can file for a divorce.


Check with the local courthouse for any restrictions.





Now if you were to move back home, and then file for the divorce, your husband would have to hire an attorney in the state the divorce was filed in.
She/He would have to reside in Georgia for at least 6 months in order to file for divorce in that state. Otherwise, the only option is to go back to the state she/he previously resided in to file.
When my parents got divorced, we lived in a state where she had no family. She simply took my brother and I with her, we boarded a plane, and flew to my grandparent's town. It's that simple.
